Renters are responsible for leaving the Boat in the same condition it was in when they collected the boat, fair wear and tear excepted.
Renters acknowledge and agree that they are responsible for their own acts and omissions and are also responsible for the acts and omissions of any individuals who you invite to, or otherwise provide access to the Boat.
Kincade Boats charges Renters the deposit the Renter agreed to pay with the Owner as part of the initial hire transaction.
At the completion of the Rental the Owner is required to follow the Off Hire Procedure to assess the boat. If the Owner believes there has been damage sustained and can prove it using the pre and post hire inspection reports, then they should notify Kincade Boats of a dispute and promptly seek quotes to repair the damage caused by the Renter.
The Renter will be advised that the Owner claims that damage occurred during the Rental Period. If the Renter accepts their responsibility then Kincade Boats will, provided the Owner has a quote to repair the damage, apply the deposit towards this loss.
If the Renter does not respond within two days of being advised of the damage claim, the Owner’s loss will be deducted from the Security Deposit (if any).
If the Owner’s loss is less than the security deposit then the balance of the deposit will be returned to the Renter.
If the Owner’s loss is greater than the deposit the Owner must lodge an insurance claim or, if insurance is not available, seek damages directly from the Renter.
If the Renter disputes their liability for the damage to the Boat then Kincade Boats will follow the Dispute Resolution Process. The Renter and Owner agree to assist Kincade Boats and act in good faith during dispute resolution. Owners and Renter will provide Kincade Boats with information and take actions as may be reasonably requested by Kincade Boats to assist in resolving the dispute.
The Fuel and Security deposit will be held until both parties have marked the rental as successfully completed or until Kincade Boats, acting reasonably and following the Dispute Resolution Process, determines that the deposit (or part thereof) should be returned to the Renter or given to the Owner to compensate for damage arising from the Rental.
